If you are charged with No Operator’s License, there may be a way that your charges could be dismissed. If you are able to get a valid drivers license issued, then you may be able to get your charges dismissed. For instance, if your drivers license expired a year and a half ago, and you simply have not looked at your license and realized that you needed to get a new one, you could be charged with No Operator’s License. It is only after you are pulled over and charged that you realize that your license is expired. Fortunately, the Assistant District Attorneys in Charlotte are typically willing to work out a deal with you: if you are able to get your license back and get it active, most of the time they will dismiss the charges against you.
Some people are unable to get a drivers license. If you are unable to get a license to take advantage of the deal mentioned above, you may be able to plea to Failure to Notify. This can save you three points on your license. You may ask, why should I worry about points on my license if I am unable to get a drivers license in the first place. In North Carolina, even if you do not have an operating license, you can still have your driving privileges “revoked.” So even if you are not licensed to drive, if you have enough points, your driving privilege can go into revoked status. If you are caught Driving While License Revoked, you are facing a Class 3 Misdemeanor. So even if you are unable to get your license, you should at least try to get it reduced to Failure to Notify DMV. It is important that you keep your record as clean as possible, because the offer to plea to Failure to Notify may not be offered if you have convictions for No Operator’s License on your record. The best thing you can do is make sure that every time you get charged with No Operator’s License you plead to Failure to Notify, to try to make sure that this option is open for you in the future.
Of course, if you are worried that you may not be able to handle this on your own, you can can call our traffic attorney and he would be glad to help.
